320 Mr. McCormack asked the Minister for Health and Children her Department's views on the EU derogation article 2.2 of 85/433 EEC which gives member states the option of not recognising the qualifications of any EU or EEA qualified pharmacist regarding ownership, management or supervision of a pharmacy that is less than three years old; and if he will make a statement on the matter. Under Article 2.2 of Directive 85/433/EEC, EU or EEA pharmacists who qualified in another EU or EEA state cannot own, operate or manage a pharmacy in Ireland that is less than three years old. The issue of the derogation was examined by the pharmacy review group. Its report was submitted to me at the end of January and I hope to publish it as soon as possible. There has been no change in the legislation affecting EU or EEA qualified pharmacists.
