Ceisteanna—Questions. Oral Answers. - Poaching by Foreign Trawlers.

asked the Minister for Agriculture if he will state the number of foreign boats captured, while poaching in our territorial waters, during the year ended March 31st, 1935; the number on which penalties were imposed; the character of the penalties; the aggregate amount of the fines levied, and if he will consider the advisability of introducing a measure providing for the forfeiture of boats caught fishing in our coastal waters and the imprisonment of the crews of such boats.

During the 12 months ended 31st March, 1935, the following vessels were convicted of infringement of our territorial rights:— (a) Two French lobster boats; (b) one British steam trawler; (c) one British long-liner. In (a) total fines of £60 were imposed and total costs of £12 awarded against defendants. The fish and fishing gear of the vessels were confiscated. In (b) a fine of £50 was imposed and costs £10 awarded against defendant. The fish and fishing gear were also confiscated. In (c) a fine of £2 was imposed and costs 36/- awarded against defendant. I am not of opinion that the provisions of the Sea Fisheries Protection Act, 1933, are inadequate for their purpose, and I do not propose to seek any extension of them.

Arising out of the Minister's reply, is he aware that those poaching trawlers have latterly a sort of co-operative scheme whereby they pool their resources to meet the fines, and the fines are so inadequate as to be no deterrent whatever? Is the Minister further aware that in other fishing countries they have taken very much more serious measures? Is he aware that recently in Norway a poaching trawler was fined £2,000?

The pooling of fines is rather an old game.

Would the Minister consider having them brought before the Military Tribunal!

Would the Minister not see that adequate fines are imposed within the resources of his own legislation?

Dr. Ryan

Under the existing legislation it is a matter for the judge to impose fines.

It is purely a matter for the judge?

Dr. Ryan

Yes.

There is no limit?

Dr. Ryan

He can impose a very substantial fine.
