170 Mr. Ring asked the Minister for Agriculture and Food when a decision on the division of commonage (details supplied) in County Mayo will be finalised. [22183/97]

In 1992 a scheme of compulsory division of commonage prepared by the Land Commission for the commonage in question, at the request of the majority shareholders, was appealed to the Judicial Commissioner of the Land Commission, (High Court), by other shareholders. An interim judgment by the Judicial Commissioner directed that certain matters, including the question of compliance with planning legislation, should be clarified before the case was returned to the Court. The planning issue was referred to An Bord Pleanála and its decision was delivered to the appellants in 1993. This decision and the other matters identified by the Judicial Commissioner as requiring clarification must be referred back to the Judicial Commissioner for consideration before the original appeal is resolved. The initiative to finalise the case rests with the shareholders in the commonage.
